I.ExecutiveSummary
Introduction
DistrictofColumbiaPublicSchools(DCPS)seektoprovideaworldclasseducatio n forallofitsstudents.
ThiscommitmentrequiresDCPStoregulateschoolbuildings,classroomsandotheraspectsoftheschool
community.Schoolsarepublicinstitutionsandshouldbeopentovisitsfromparentsandother
interestedpartiesto
theextentthatvisitsdonotcompromisestudentorstaffsafetyanddonotdisrupt
theeducationprocessorschool’soperation.Schoolbuildingswillcontinuetobeopentothepublicas
longasvisitorsdonotdisruptschoolinstruction,operation,oractivities;orcompromisethesafetyand
securityof
studentsandstaff.
Purpose
Thisdirectiveexplainstheproceduresforschoolbuildingvisits.Theguidanceinthisdirectiveappliesto
theschoolbuildingandallexteriorgroundsoftheschool,includingtheplaygroundandanyother
buildingsandareasonDCPSproperty.Theschoolprincipalhasprimaryresponsibility forensuringvisitor
accessintheschool
buildingandvisitorconductaremonitoredandsupervisedwhileonschool
property.Theprincipalhastheauthoritytodenyaccesstoanyindividualseekingtoentertheschoolif
theprincipaldeterminesthatthevisitor’spresenceposesadangerordisruptiontoschoolactivities,
schoolinstruction,orstudentsandstaff.
Visitorswhoposeathreatordisruptiontotheschool
environmentmaybedeniedaccessorbarred,subjecttotheprovisionsofDCPSSchoolBarringNotice
Procedures.ThisdirectiverescindstheChancellor’sDirective,SchoolVisitors,SchoolRecordsRelease
andBarringNoticeProcedures,issuedonFebruary19,2013,andfurtherrescindsany
otherdocument
issuedbyDCPStodateregardingpoliciesorproceduresforschoolvisitors.
Roadmap
Thisdirectivewillprovidegeneralproceduresthatapplyforallschoolvisits,aswellasspecificguidelines
forparentsandlegal/courtappointedguardians,professionals,lawenforcementofficials,and
attorneys.Thedirectivealsoincludesspecificinformationrelatedtothereleaseofstudentrecords.The
appendixattheendofthedocumentincludes

II.SchoolVisitorProcedures
A.SecurityProceduresforAllSchoolVisitors
Allvisitorsandschoolstaffmustcomplywiththefollowingproceduresregardingschoolvisits:
1. Themainentranceoftheschoolbuildingshallbeusedforallexitsandentriestotheschool,
exceptincasesoffireoremergency.Anypersonfoundviolatingthisrulewillbeimmediately
reportedto
theprincipalorschoolsecurityofficer.
2. Thefollowingsignshallbepostedatthemainentrancetoallschoolbuildings:
3. Allvisitorsmustimmediatelyreporttothesecuritydeskorstationtoidentifythemselvesand
receiveavisitor’sbadge.Properidentificationmustbepresentedinorder
toreceiveabadge.
Properidentificationincludesadriver’slicenseorothergovernmentissuedpersonal
identificationcard,passport,oracurrentemployeeidentificationcardfromalocalorfederal
governmentagencyorprivateentity.
4. Allvisitorsmustsigntheschoolsecurityvisitor’slog.Thelogshallhaveappropriatecolumnsso
thatvisitorscanprovidetheirname,agency/office,purposeofvisitorpersontheyarevisiting,
timesofentryanddeparture,andbadgenumberifapplicable.
5. Visitorsmustfollowtheinstructionsprovidedtothematthesecuritystation.Asdirectedbythe
principal,schoolsecuritymaylimittheareasand
timeduringwhichthevisitormayaccessthe
building,butnotinamannerthatwillunreasonablyinfringeupontherightsofaparentora
parent’sdesigneetoobserveorsupportachildintheclassroom.Thescopeanddurationofthe
visitwillcorrespondwiththepurposeofthe
visit.
6. Visitorsmustwearordisplaytheirvisitor’sbadgeatalltimeswhileonschoolpremises.
7. Allvisitorsmustsignoutonthevisitor’slogpriortoexitingthebuildingandreturntheirvisitor
badgetosecurity.
8. Allstaffmembersshallrelayconcernsregardingthepresenceor
conductofvisitorstoschool
securityortheprincipalimmediate lysothatfurtherappropriateactionmaybetaken.
B.ParentsandLegal/CourtAppointedGuardians
Parentsandguardians‐includingeducationalsurrogateparentsappointedbytheOfficeoftheState
SuperintendentofEducation(OSSE)ortheFamilyCo urtoftheD.C.SuperiorCourt—shouldbegiven
widelatituderegardingaccesstotheschoolforthepurposesofmeetingwiththeirchild’steacheror
otherschoolstaff,orobserving
theirchild’sclass.Parentsandguardiansofprospectivestudentsshould

Uponenteringthisbuildingyoumustreportimmediatelytothe
administrativeofficeandreceivepermissiontobeonthepremises.
Onlythoseindividualswhohaveschoolrelatedbusinesswillbegranted
permissiontoremain.Anyunauthorizedentrantisinviolationof
Section223302(b)oftheD.C.Codeand
willbecriminallyprosecuted.

alsobegivenareasonableopportunitytovisittheschoolandtoobserveproposedclassesuponrequest.
However,aparentorguardian’spresenceintheschoolmustnevercauseadisruptiontothefunctionof
theschoolortheinstructionalprogramofanystudentorinanyway
compromisethesafetyorsecurity
oftheschool,students,orstaff.
Relativesorcaretakerswhoarenotthechild’sguardianwillbeallowedtovisittheschooliftheyare
accompaniedbyaparentorguardianoriftheyhavereceivedpermissioninadvancefromthechild’s
parentorguardian
andtheschoolprincipal.Ifarelativeorcaretakerappearsontheemergencycontact
listforastudent,therelativeorcaretakershouldbeallowedaccesstotheschooltodropthestudentoff
orpickthestudentup.
Intheeventthatacourtorder,decree,oragreementdescribesthe
rightsofparents,guardiansand/or
otherrelativeswithrespecttoachild,theaccessthattheschoolmayprovidetothechildmustbe
consistentwiththatorder,decree,oragreement.Thatcourtorder,decree,oragreementshouldbe
providedbytheparenttotheschoolassoonasreasonably
possible.Applicablecourtorders,decrees,
oragreementssupersedeallotherprovisionsofthisdirective.SchoolstaffshouldcontacttheDCPS
OfficeoftheGeneralCounsel(OGC)forguidanceoninterpretingthetermsofacourtorder,decree,or
agreement.
C.VisitorsParticipatinginIEP/504Meetings/ObservationsofStudentswith
Disabilities
NonschoolstaffmayvisitDCPStoparticipateinIEPmeetingsortoobservestudentswithdisabilitiesin
classroomsettings.Thesevisitsmustcomplywiththefollowingp rocedures:
IEP/504Meetings
Visitorsmaybeallowedentrytotheschoolforthepurposeofmeetingwithschoolstaffregardinga
studentwhois
receivingspecialeducationservicespursuanttotheIndividualsWithDisabilities
ImprovementinEducationActof2004(IDEA).Suchvisitorsmayinclude:educationaladvocates,
attorneys,guardianadlitemattorneys,evaluators,andparentdesignees.However,thesevisitorsshould
onlyremaininthebuildingforthepurposeanddurationoftheirscheduledIEP
meetingandshouldnot
beallowedtowalkunaccompaniedthroughtheschoolortoobservestudentsinclassunlessthe
circumstancesdescribedbelowinSectionC.2,ClassroomObservationsforStudentswithSpecialNeeds,
apply.Thefollowingguidelinesshallapplytovisitorsintheschoolforspecialeducationmatters:
a. All
SecurityproceduresinSection A,above,mustbeadheredto;
b. Uponarrivaltotheschool,theevaluator,educationaladvocate,outsideobserver,orsimilar
visitormustreporttotheprincipaloraprincipal’sdesignee;and
c. Individualswhohavebeenbarredfromaschoolthroughabarringnoticeorcourtorder
but
whoneedtoparticipateinanIEPmeetingmayparticipatebyphone.
ClassroomObservationsforStudentswithDisabilities

ObservationscanbeconductedbyparentsasstatedinSectionBabove.Parent’sdesigneesand
professionalscompletingevaluationsofastudentattheschoolwillalsobeallowedtoobservethechild
intheclassroom.Professionalevaluatorsconductinganassessmentmustpresentanauthorizationletter
fromtheparent.Theauthorization
lettershouldindicatewhatassessmenttheevaluatorisconducting,


andincludetheparent’ssignaturegivingpermissiontoconducttheassessmentofthestudentatschool.
Thirdpartypersons(includingattorneysandeducationaladvocates)whoarenotevaluators,Hearing
Officerdesignatedexperts,parents,orparentdesignee(s)shallnotbeallowedtoobserveclassrooms
whilechildrenareinthe
classroom.Aparentofachildwithadisabilitymayappointadesigneeto
observethechild’scurrentorproposedspecialeducationalprogram.Thisdesigneemust:
a. Haveprofessionalexpertiseintheareaofspecialeducationbeingobserved;
b. Benecessarytofacilitateanobservationforaparentwitha
disability;or
c. Benecessarytoprovidelanguagetranslationassistancetoaparent.
Aparentappointeddesigneemaynotrepresentthechildorfamilyinlitigationrelatedtotheprovision
ofafreeandappropriatepubliceducation(FAPE)norcanthedesigneehaveafinancialinterestinthe
outcomeofsuch
litigation.Adesigneemustagreeinwritingthattheywillnotdisclosenoruseany
informationobtainedduringthecourseofanobservationforthepurposeofseekingorengagingclients
inlitigationagainsttheDistrictortheLEA.Inaddition:
a. AllsecurityproceduresinSectionA,above,must
beadheredto;
b. Allclassroomobservationsmustbescheduledpriortothedayofarrivalattheschool;
c. Priortotheinclassobservations,anyobservermustcompleteandprovidetotheprincipal
theConfidentialityAgreement(seeAppendix);
d. Inappointingaparent’sobserver,theLEAmayrequireadvancenoticeandforthe
designationtobeinwriting,bycompletingtheObservationDesigneeForm(seeAppendix)

e. Theparent,designee,orevaluatormustactinsuchamannerthatallowstheregularschool
programtocontinueduringtheobservationbyrefrainingfromengagingtheattentionofthe
teacherorotherstudent(s)throughconversationorothermeans;
f. Theparent,designee,orevaluatormaybeaccompaniedbyDCPS
personnelatthediscretion
ofDCPS;
g. Attorneyswhoarerepresentingtheparent’schildinlitigationrelatedtotheprovisionofa
freeandappropriateeducation(FAPE)shouldonlybeinthescho olbuildingtoattenda
student’sIEPmeeting,toretrievestudentrecords,ortospeakwithamember
oftheschool
staff.Attorneyshavenolegalrighttoobserveanyclassandshallnotbepermittedtodoso;
h. Inallinstancesofprofessionalsvisitingtheschoolforspecialeducationmatters,an
appointmentshouldbemadewiththerelevantschoolstaffpersonoranIEPmeetingshould
be
previouslyarrangedandnoticeissuedtoallrelevantattendees;
i. Schoolstaffareundernoobligationorrequirementtomeetwithanattorney,educational
advocate,orobserverortoallowthemaccesstotheschool,ifpriorarrangementshavenot
beenmadeandagreedupon;and


mattersshallhavenodirectinteractionwithstudents,includingthestudentwhoisthe
subjectoftheobservation.
D.AttorneysandLegalProfessionals
Undercertaincircumstances,attorneysandotherlegalprofessionalsmayhavereasontovisitschools.
Thesevisitsmustcomplywiththefollowingprocedures:
AllAttorneysandLegalProfessionals
Allattorneysandlegalprofessionals(includingthosefromtheUnitedStatesAttorney’sOffice(USAO),
theOfficeoftheAttorney GeneraloftheDistrictof
Columbia(OAG),andPublicDefenderServiceand
anyprivateattorney)mustshowtheirbadgesandidentificationatthesecuritystation.Theymustthen
bedirectedtothemainofficetospeakwithaprincipaloradesignee.
Ifanyattorneyorlegalprofessionalwishestoreceiveeducationrecordsorany
informationcontainedin
educationrecords,theprincipaloradesigneemustcontactDCPSOGCtoreceiveclearancetorelease
suchrecordsorotherstudentdata.
GuardianadlitemAttorneys
Guardianadlitemattorneysmayobserveclassesiftheypresentacourtorderorotherreliable
documentationindicatingtheyarepermittedto
doso.Thevalidcourtorderorotherlegallybinding
documentmustdemonstratetheattorney’srelationshipasguardianadlitemforthechild. Thecourt
ordermustbesignedbyajudge,mustindicatethestudent’sname,andmustbedatedwithinone
calendaryearofthevisit.
Attorneysfrom
OAGorUSAO
IfanattorneyfromOAGorUSAOhascometoquestionastudent regardingamatter,theattorneymust
firstobtainconsentfromthestudent’sparentifthestudentisunder18.Theprincipaloradesigneecan
contactthestudent’sparenttoreceiveconsentfortheattorney
totalktothestudentortoallowthe
parenttimetocometoschooltoparticipateintheinterview,butisnotrequiredtodoso.Ultimatelyitis
uptotheattorneytoobtaintherequiredconsent.
IfanattorneyfromOAGorUSAOhascometothe
schooltoinvestigateamatterandwishestospeak
withschoolstaff,theprincipalandallschoolstaffshouldcooperateandansweranyquestions,aslong
asnounduedisruptionsarecausedtotheschoolenvironmentortoclassinstruction.
AttorneysServingaSubpoena
Ifanattorney(oranattorney’sinvestigator
orprocessserver)wantstoserveasubpoenaonDCPSora
DCPSemployeeintheircapacityasagovernmentemployee,theschoolstaffshallinformtheattorney
thatDCPSOGCacceptsserviceonbehalfofDCPS.Thestaffpersonshouldthenrequestthatthe
attorneytakethesubpoena to
DCPSOGCinCentralOffice.Iftheattorneyrefuses,schoolstaffshould
contactOGCforassistance.Ifnecessary,OGCwillauthorizeschoolstafftoacceptthesubpoenaand
thenimmediatelysendittoOGCforreview.
AttorneysfromthePublicDefenderServices(PDS)
ForattorneysfromthePublicDefenderService(PDS),
andprivateattorneys(andtheirinvestigatorsand
processservers),thefollowingguidelinesmustbefollowed:
SchoolstaffshouldcontactDCPSOGCforguidancebeforeengagingwithPDSand/orprivateattorneys
inanymatter.

Undernocircumstancesshouldsuchattorneyshaveanydirectinteractionwithstudents,unlessthe
attorneyisrepresentingthestudentincourtcase.Inthatinstance,theattorneymaybeallowedto
interactwiththestudentinamannerthatminimizesdisruptiontothestudent’sclassroominstruction.
Ifthestudent
isunder18,schoolstaffmustcontactaparent/guardiantoobtainconsentpriorto
allowingaccess.
SchoolemployeesarenotrequiredtospeakwithattorneysfromPDSunlessavalidsubpoenahasbeen
issuednamingtheemployeeasawitnessinacourtproceeding.Theseproceedingswill alwaysinvolve
the
governmentinsomecapacity.Ifasubpoenahasbeenissuedandtheissuingattorneyor
investigatorwishestospeakwiththeemployee,theprincipalora designeeshouldallowtheemployee
tospeakwiththeissuingattorney/investigatoraslongasitposesonlyminimaldisruptionstotheschool
environmentorto
classinstruction.
Schoolemployeesarenotrequiredtospeakwithattorneysrepresentingparentsinprivatecustody
proceedingsthatdonotinvolvethegovernmentunlessavalidsubpoenahasbeenissuednamingthe
employeeasawitnessinaprivatecustodyproceeding.DCPSOGCcanacceptserviceofprivatecustody
subpoenas
onanemployee’sbehalfwiththeemployee’spermission.However,ifanemployeeisserved
withasubpoenainaprivatecustodymatter,theprincipalortheemployeeshouldcontactDCPSOGC
forguidance.Theprincipalshouldallowtheemployeetospeakwiththeissuingattorney/inv estigator as
longasitposesonly
minimaldisruptionstotheschoolenvironmentortoclassinstruction.Employees
mayalsobeentitledtoreceivewitnessappearancefeesinprivatecustodymatterssolongasnoofficial
governmentresources(includingthee mployee’sdutytime)areutilized.
E.LawEnforcement,Investigators,andOtherGovernmentOfficials
Schoolsshouldmakeeveryefforttocooperatewithlawenforcement,including:local,state,andfederal
policeofficers/investigators,investigatorsfromtheDCOfficeoftheInspectorGeneral(OIG),D.C.Child
andFamilyServicesAgency(CFSA),ortheDCPSInvestigationTeam.However,schoolvisitsshouldbe
conductedinamannerthatdoes
notdisrupttheschoolenvironmentorclassinstructionunless
absolutelynecessary.

III.ReleaseofStudentRecords
TocomplywiththeFamily EducationalRightsandPrivacyAct(FERPA),DCPSmustnotprovideaccessto
confidentialstudentrecords,ordiscussthecontentofsuchrecords,withoutwrittenauthorization
grantedbytheparent/guardian oradultstudent,orviacourtorder(seeAppendixforDCPS
AuthorizationtoReleaseRecords).The
principalshouldcallDCPSOGCwithanyquestionsrelatedto
FERPAoreducationrecordsaccess.
1. Forprivateattorneys/thirdparties,theschoolmustreceiveawrittenconsent(seeAppendixfor
DCPSAuthorizationtoReleaseRecords),signedwithinoneyearofthedateoftherecords
request.
2. Forguardianad
litemattorneysandsocialworkers,theschoolmustreceiveacourtorderor
otherdocumentthataffirmativelygrantsaccesstotherecords.
3. Forsocialworkersfromchildwelfareagencies,thesocialworkershouldhavevalididentifi cation
tosubstantiatetheirstatusasanemployeeofachildwelfareagency,alongwith
acourtorder,a
validauthorizationforreleaseofrecordsorotherdocumentthatexplicitlygrantsthemaccessto
therecordsofaparticularstudent(s).
