This cause came to be heard on the motion for revivor of the Judgment herein, and the
Court finds that the Judgment Debtor, ________________________________, has been

REVIVING A DORMANT JUDGMENT
A judgment becomes dormant if no action is taken to enforce it for a period of five (5) years.
The Judgment Creditor (the person who has the judgment) may file a motion to revive the judgment
any time within the next ten (10) years.
Once a judgment is revived, it is enforceable and the Judgment Creditor can take steps to collect the
judgment. The judgment will become dormant in five years if no action to collect is taken.
To revive a dormant judgment the Judgment Creditor can take the following steps.
1. Prepare a “Motion to Revive Dormant Judgment” and Entry for Revivor of Judgment. The
forms are available at http://smallclaims.fcmcclerk.com/home/court-forms
and in the Small
Claims Division. You will need the original forms, a copy for your records and one for each of
the defendants.
2. The cost to file the Motion for Revivor is $30.00 for up to three defendants You will need to
provide Instructions for Service to the Clerk that tell the Clerk you are requesting service for
the defendant(s) at the address you provide and the kind of service you want. Instructions
are available at http://smallclaims.fcmcclerk.com/home/court-forms
, in the Small Claims
Division or the Clerk’s Civil Division, 375 S. High St., 3

floor.
3. The Clerk will prepare a summons to send with a copy of the Motion to Revive Dormant
Judgment. The Judgment Debtor(s) has 28 days from the date when the motion is served to
respond. To determine the date the Judgment Debtor was served, you can check the public
access page of the Clerk’s web site: www.fcmcclerk.com
. If the information is not available on
the web page, you may call the Clerk of Court at 645-7020 and ask the clerk to look this up in
your case file. The Revivor will not be approved until there is service of process. (More
information about service is at www.fcmcclerk.com
under Small Claims.) If the Judgment
Debtor responds to the motion, the case will be referred to a judge for consideration.
4. If the Judgment Debtor(s) does not respond by the 31
st
day after service, you may file the
“Entry for Revivor of Judgment” with the Clerk on the 3
rd
floor. You may send the Entry to the
Clerk of Court by mail. To obtain a copy of the final Entry, enclose a stamped self-addressed
envelop with the Entry.
5. A Judgment creditor is entitled to the interest that would apply to the original Judgment. Usually
you cannot calculate interest for the time the judgment is dormant. There are some exceptions
to this general rule. If you use the Judgment Interest Calculator in the Forms Section of the
Small Claims Division of the web page: http://smallclaims.fcmcclerk.com/home/court-forms
, you
can determine the time that your judgment accrues interest. A Judgment Interest Calculation
